Terms of Service

Welcome to ModaMix (also referred to as “ModaMix Inc.,” the “Company,” “we,” “our,” or “us”). These Terms of Service govern access to and use of https://www.modamix.vip, purchases, accounts, communications, and related services. By using the website or placing an order, you agree to these Terms.

1. Eligibility and Accounts

You must be at least 18 or the age of majority in your jurisdiction and legally able to enter a binding agreement. Provide accurate order, payment, shipping, and contact information. You are responsible for safeguarding account credentials and activity under your account.

2. Product Information, Pricing, and Availability

Descriptions, colors, dimensions, ingredients, materials, scent or flavor notes, sizes, prices, promotions, and availability appear on the applicable product page. Screens and photography may display color differently. The label and instructions delivered with a product provide the controlling use, ingredient, warning, shelf-life, period-after-opening, and care information. We may correct typographical, pricing, or inventory errors before shipment and will contact you if a material change affects an accepted order.

3. Orders and Payments

Orders are subject to acceptance, payment authorization, inventory availability, address restrictions, and fraud review. Taxes, shipping charges, discounts, and accepted payment methods are shown at checkout. If a charged order is canceled, the applicable amount will be returned to the original payment method.

4. Shipping, Returns, and Product Quality Support

Processing and delivery dates are estimates. Eligible returns are available within 30 days after delivery. Product quality support is available for products that arrive damaged, defective, contaminated, leaking, incorrectly supplied, or with a broken safety seal. Eligibility, hygiene exclusions, evidence requirements, and available resolutions appear in Shipping, Returns & Product Quality Support. This support applies to qualifying product-quality issues and does not replace the shelf-life, expiration date, or period-after-opening information shown on cosmetic and personal-care packaging.

5. Beauty and Personal-Care Products

Cosmetics and personal-care products are for external use unless the label expressly states otherwise. Follow ingredient lists, directions, patch-test guidance, age limits, expiration dates, period-after-opening symbols, and warnings. Once opened, use the product within the period printed on its packaging, such as 10M or 12M when that symbol appears. Stop use if irritation occurs and seek medical care when appropriate. Cosmetic descriptions concern appearance, cleansing, conditioning, scent, or routine use and are not medical advice or promises to diagnose, treat, cure, or prevent disease. Sunscreen must be used according to its Drug Facts label and does not eliminate sun-exposure risk.

6. Accessories

Use accessories and beauty tools only as intended. Keep small parts away from children and pets. Jewelry and metal accessories may cause sensitivity in some users; discontinue wear if irritation occurs. Materials, dimensions, and care instructions are stated on product pages.

7. Pet-Life Products

Pet products are not toys for children and are not substitutes for veterinary care. Select the correct size, supervise use where directed, inspect frequently, and replace damaged items. Do not allow ingestion of non-food products. Stop use and consult a veterinarian if a pet shows injury, irritation, or unusual behavior.

8. Reviews, Feedback, and User Content

Content you submit must be truthful, lawful, and yours to share. Do not submit private information about another person, misleading claims, malicious files, or infringing content. You grant ModaMix a non-exclusive license to use feedback to operate and improve the business; public use of reviews or media will follow the permissions presented when submitted.

9. Intellectual Property and Acceptable Use

ModaMix names, logos, copy, product images, graphics, interfaces, and site content are owned by or licensed to ModaMix Inc. You may not reproduce, scrape, modify, distribute, reverse engineer, interfere with security, introduce malicious code, impersonate others, or use the Services unlawfully.

10. Email, SMS/MMS, and Voice Communications

10.1 Transactional Communications

When you place an order, create an account, contact support, or request a service, we may send non-marketing communications by email, text message, or telephone concerning order confirmation, payment, shipping, delivery, returns, refunds, account security, fraud prevention, customer service, product-quality support, safety notices, or a request you initiated. Transactional message frequency depends on your orders, account activity, and requests. Standard carrier, message, data, or telephone charges may apply. Marketing opt-out requests do not prevent us from sending communications that are necessary to complete a transaction, protect an account, respond to you, or satisfy legal or safety obligations, although we may use another available channel when appropriate.

10.2 Email Marketing

If you affirmatively subscribe, or where otherwise permitted by applicable law, ModaMix may send product news, editorial content, promotional offers, event notices, surveys, and other marketing emails. Each marketing email will identify ModaMix as the sender and provide a clear unsubscribe method. You may unsubscribe at any time through the link in the email or by contacting hello@modamix.vip. We do not charge a fee or require information beyond what is reasonably necessary to process the request. We will honor a valid email-marketing opt-out within 10 business days as required by applicable law. An unsubscribe request applies to marketing email and does not stop transactional or relationship messages described in Section 10.1. If you later subscribe again, the newer request will apply.

10.3 SMS/MMS Terms and Marketing Consent

If SMS/MMS messaging is offered, you may affirmatively opt in by submitting a mobile number through the disclosed sign-up method. By doing so, you authorize ModaMix and service providers acting on our behalf to send recurring text or multimedia messages to that number for the purposes shown at opt-in. Marketing messages may include product announcements, offers, cart or browsing reminders where permitted, and brand updates. Marketing-text consent is voluntary, is not a condition of purchasing any product or service, and may be withdrawn at any time.

Promotional message frequency will not exceed 4 messages per month unless a different frequency is clearly disclosed when you opt in. Transactional message frequency varies with account activity and requests. Message and data rates may apply. Contact your wireless provider for plan details.

To stop messages covered by your consent, reply STOP or use another reasonable opt-out method stated in the message or contact hello@modamix.vip or +1 (720) 348-6219. We may send one final non-marketing message confirming the opt-out. For help, reply HELP or contact us using the information above. An SMS opt-out does not automatically unsubscribe the same contact information from email marketing, and an email unsubscribe does not automatically revoke SMS consent; each channel can be managed separately.

10.4 Marketing and Prerecorded Voice Calls

If voice marketing is offered and you separately provide the consent required by applicable law, you authorize ModaMix and service providers acting on our behalf to place marketing or promotional calls to the telephone number you designate. Where disclosed and legally permitted, such calls may use an automatic telephone dialing system, other automated dialing technology, or an artificial or prerecorded voice. Consent to receive marketing calls is voluntary and is not a condition of purchase.

You may revoke voice-marketing consent at any time through a reasonable method, including telling the caller that you do not wish to receive further marketing calls from ModaMix or contacting hello@modamix.vip or +1 (720) 348-6219. We will process the request within the time required by applicable law. Calls and messages will be initiated only at times permitted by applicable law.

10.5 Your Number, Eligibility, and Consent Records

By opting in to text or voice communications, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, that you are the subscriber or customary user of the number provided, and that you are authorized to give consent for that number. Notify us promptly if the number is reassigned, disconnected, or no longer belongs to you. We may maintain records of the opt-in language presented, the date, time, source, telephone number, consent status, and opt-out request to administer the program and demonstrate compliance.

10.6 Service Providers, Carriers, and Delivery

We may use communications platforms, telephone providers, email vendors, and other contractors to deliver messages or calls on our behalf. They may process contact information and consent records only to provide contracted services, support compliance, or as otherwise disclosed in our Privacy Policy; your consent is not permission for them to market their own products or services to you. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to network availability, device compatibility, carrier participation, spam filtering, and events outside our control. Not all message types or features are supported by every device or carrier.

10.7 Suspension or Changes

We may suspend or end a messaging or calling program, change a short code, sending number, frequency, or supported feature, or update these communication terms. Material changes will be disclosed as required by law. If consent is legally required for a materially different marketing purpose, we will request it before sending that communication.

11. Disclaimers and Limitation of Liability

Except for product-quality resolutions expressly provided in our policies and rights that cannot lawfully be excluded, the website is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, ModaMix Inc. is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Nothing in these Terms limits non-waivable consumer rights.

12. Indemnity

To the extent permitted by law, you agree to be responsible for losses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.

13. Governing Law, Severability, and Changes

These Terms are governed by applicable U.S. federal law and Colorado law without overriding mandatory consumer protections. If a provision is unenforceable, the remaining provisions continue. We may post revised Terms with a new effective date.
